SuperGuide operates a digital platform that enables users (“Guests”) to discover and book experiences provided by third-party suppliers through curated recommendations.
2. Scope of These Terms
2.1 Application
These Terms and Conditions (“Terms”) govern your access to and use of:
The SuperGuide website and mobile interfaces
All content, features, and services made available through the platform
Any bookings made via SuperGuide
2.2 Nature of the Platform
SuperGuide provides a technology platform that enables:
Suppliers to offer experiences
Guides to curate and recommend experiences
Guests to discover and book such experiences
2.3 No Ownership of Services
SuperGuide does not own, operate, control, or provide any experiences listed on the platform.
2.4 Contractual Relationships
When you make a booking, you enter into a direct contract with the Supplier, not with SuperGuide.
2.5 Additional Terms
Certain services or experiences may be subject to additional Supplier terms, which form part of your contract with the Supplier.
3. Role of SuperGuide
3.1 Agency Role
SuperGuide acts solely as a disclosed commercial agent on behalf of Suppliers.
3.2 Scope of Agency
SuperGuide’s role is limited to:
Facilitating discovery of experiences
Enabling bookings
Processing payments on behalf of Suppliers
3.3 No Liability for Services
SuperGuide is not responsible for the performance, quality, safety, or legality of any experience.
3.4 Payment Effect
Payment made via SuperGuide is deemed payment made directly to the Supplier.
4. Eligibility and Account
You must:
Be at least 18 years old
Have legal capacity to enter into contracts
Provide accurate and complete information
You are responsible for all activity under your account.
5. Use of the SuperGuide Platform
5.1 Permitted Use
You may use the platform solely for:
Browsing experiences
Making legitimate bookings
Accessing recommendations for personal, non-commercial use
5.2 Prohibited Uses
You agree not to, and not to assist others to:
Platform Abuse
Use the platform for unlawful, fraudulent, or misleading purposes
Circumvent or manipulate booking, pricing, or payment systems
Create fake accounts or provide false information
Anti-Scraping & Data Protection
Access, scrape, crawl, extract, copy, or harvest content or data from the platform by any automated or manual means
Use bots, spiders, scripts, or other automated tools
Reproduce, duplicate, or commercially exploit any content (including listings, pricing, descriptions, or guide recommendations)
Competitive Use
Use the platform or its data to build, train, or operate a competing product or service
Reverse engineer or attempt to derive source code, algorithms, or business logic
Technical Interference
Interfere with platform security, infrastructure, or performance
Circumvent access controls or protective measures
5.3 Enforcement Rights
SuperGuide reserves the right to:
Suspend or terminate access
Remove content
Take legal action
for any breach of this section.
6. Bookings and Contract Formation
6.1 A booking is confirmed when:

Payment is successfully processed, and

Confirmation is issued
6.2 The Supplier is solely responsible for:

Delivering the experience
-
Defining conditions and requirements
-
Compliance with applicable laws
7. Pricing and Fees
7.1 Prices are determined by Suppliers and may include:

Taxes
-
Supplier charges
-
SuperGuide commissions
7.2 Payment Processing Fee
SuperGuide may charge a payment processing fee of up to 2.8% of the transaction amount.
7.3 Prices may change at any time before booking confirmation.
8. Best Price Guarantee
8.1 SuperGuide may offer a Best Price Guarantee.
8.2 If you find an identical experience offered at a lower price:

By the same Supplier

Under identical conditions
SuperGuide may, at its discretion:

Refund the difference, or
-
Provide credit
8.3 Claims are subject to verification and eligibility criteria.
9. Payments
9.1 You authorize SuperGuide to charge your payment method for:

Booking amounts
-
Applicable fees
-
Additional charges (where applicable)
9.2 Payments may be processed by third-party providers.
9.3 Your bank or provider may apply additional fees.
10. Cancellations, Changes and Refunds
10.1 Supplier Policies Apply
Cancellation and refund terms are set by Suppliers.
10.2 Platform Role
SuperGuide facilitates refunds but is not responsible for Supplier decisions.
10.3 No refunds may be granted for:

No-shows

Late arrivals

Failure to meet requirements
11. Guide Recommendations Disclaimer
11.1 Recommendations are provided by independent guides.
11.2 SuperGuide does not guarantee:

Accuracy
-
Suitability
-
Completeness
11.3 Guides receive a curation fee linked to bookings.
12. Liability
12.1 Suppliers are solely responsible for experiences.
12.2 To the maximum extent permitted by law, SuperGuide is not liable for:

Personal injury
-
Property damage
-
Service failures
12.3 Liability cap: Limited to the total amount paid for the booking.
12.4 Mandatory legal rights remain unaffected.
13. Payment Collection & Agency Confirmation Pricing and Fees
You acknowledge that:

SuperGuide acts as agent of the Supplier

Payment to SuperGuide fulfills your obligation to the Supplier

Disputes regarding experiences must be addressed to the Supplier
14. Assignment and Corporate Structure
SuperGuide may Transfer obligations to Astrosphere Lda subsidiaries within the EU
This will not reduce your statutory rights.
15. Suspension and Termination
We may suspend or terminate access to your account if:

Terms are breached

Fraud is suspected

It is required by law
16. Governing Law and Jurisdiction
These Terms are governed by Portuguese law. EU consumers retain the right to bring claims in their country of residence.
17. Change of Terms
We may modify these Terms with prior notice. Continued use constitutes acceptance.
